ACCEPTABLE USE POLICY (AUP)

1. Introduction
Speedsurf (Pty) Ltd ("Speedsurf", "we", "us" or "our") is committed to providing reliable Internet and related services while complying with applicable South African law and protecting the security, integrity and performance of its network.
This Acceptable Use Policy ("AUP") sets out the rules governing the use of services supplied by Speedsurf and is intended to ensure that Customers can make use of Speedsurf's network and the Internet without unreasonable interference, abuse or disruption caused by other users.
By using any Speedsurf service, the Customer agrees to comply with this AUP and remains responsible for the use of the service by any person accessing the service through the Customer's account, connection or equipment.
This AUP must be read together with Speedsurf's applicable Terms and Conditions, service agreement, Privacy Policy and any product-specific terms.
2. Scope
This AUP applies to all Internet and IP-based services supplied by Speedsurf, including, where applicable:
- Fixed wireless and AirFibre Internet services;
- fibre and other Internet access services;
- business and dedicated Internet services;
- Wi-Fi and managed network services;
- hosting, email and related IP services; and
- any other service making use of Speedsurf's network or Internet connectivity.
3. General Acceptable Use
Customers must use Speedsurf's services responsibly, lawfully and in a manner that does not negatively affect Speedsurf, its network, other Customers, other Internet users or third-party networks.
The Customer may not knowingly create, store, publish, transmit, download, distribute or make available unlawful content using Speedsurf's services.
Customers must comply with all applicable South African laws and regulations and may not use Speedsurf's services to facilitate, encourage or participate in unlawful activity.
4. Prohibited Activities
The use of Speedsurf's services for any of the following purposes is prohibited:
- committing, facilitating or encouraging any criminal or unlawful act;
- interfering with or disrupting Speedsurf's network or systems or those of another service provider;
- interfering with another person's reasonable use or enjoyment of Internet services;
- violating the privacy, confidentiality or security of another person or organisation;
- infringing copyright, trademarks, patents or other intellectual property rights;
- publishing or distributing content that is unlawful, defamatory, threatening, harassing or constitutes
- unlawful hate speech;
- fraud, phishing, impersonation or other deceptive activity;
- distributing malware or malicious software; or
- engaging in any activity that creates an unreasonable security or operational risk to Speedsurf or
- another network.
5. Intellectual Property
Speedsurf's services may not be used to knowingly publish, reproduce, transmit, distribute, upload, download or otherwise make available material in violation of copyright, trademark, patent, trade secret or other intellectual property rights.
The Customer is responsible for ensuring that it has the necessary rights or permissions for material transmitted, hosted or distributed using the service.
6. Spam and Unsolicited Communications
Customers may not use Speedsurf's services to send or promote unsolicited electronic communications ("spam").
Prohibited activities include, but are not limited to:
- sending unsolicited bulk email or other electronic messages;
- sending commercial communications without the required consent or lawful basis;
- sending messages to recipients who have opted out;
- operating an unauthorised open mail relay;
- using third-party systems to relay messages without permission;
- falsifying or concealing sender, header, routing or originating information;
- harvesting email addresses or other contact information without lawful authority;
- using compromised devices or accounts to distribute spam; and
- advertising a website, product or service through unlawful unsolicited communications.
Speedsurf may take reasonable technical measures to identify, restrict or prevent spam originating from or passing through its network.
Complaints relating to spam or network abuse may be submitted to abuse@speedsurf.co.za.
7. Network and Security Abuse
Customers are responsible for taking reasonable steps to secure devices and systems connected to Speedsurf's network.
Customers may not:
- gain or attempt to gain unauthorised access to any computer, network, account or system;
- scan, probe or test systems or networks without authorisation;
- intercept communications or data without lawful authority;
- conduct denial-of-service or distributed denial-of-service attacks;
- deliberately flood or overload networks or systems;
- distribute viruses, worms, ransomware, spyware, Trojan horses, rootkits or other malicious software;
- operate botnets or knowingly allow compromised equipment to participate in a botnet;
- use tools intended to defeat or circumvent network security without lawful authorisation;
- spoof or falsify IP addresses, packet headers or identifying information for an unlawful or abusive
- purpose; or
- knowingly permit an unsecured or compromised system to cause harm to Speedsurf or third-party networks.
Legitimate security testing conducted with the express authorisation of the owner of the affected systems is not prohibited merely because security tools are used.
8. Protection of Children and Vulnerable Persons
Speedsurf's services may not be used for any unlawful activity involving children or vulnerable persons.
The creation, possession, distribution, transmission or accessing of child sexual abuse material or other content prohibited by applicable law is strictly prohibited.
Where Speedsurf becomes aware of content or activity that is required by law to be reported, Speedsurf may preserve relevant information and report the matter to the appropriate law-enforcement or regulatory authority.
Parents and guardians remain responsible for supervising minors' use of Internet services and are encouraged to make use of appropriate parental-control and content-filtering technologies.
9. Fair Use Policy and Uncapped Services
Speedsurf provides Internet access over a network shared by multiple Customers. Network capacity is therefore a finite resource which must be managed responsibly to provide a reasonable service to all Customers.
An "uncapped" service means that Speedsurf does not impose a predetermined monthly data-volume cap unless specifically stated for the relevant product. It does not mean that network resources are unlimited or that a Customer may use the service in a manner that materially and unreasonably affects other Customers.
Speedsurf may implement reasonable network-management measures where necessary to:
- protect network stability and security;
- manage congestion;
- prevent abuse;
- mitigate attacks or malicious traffic;
- maintain reasonable service levels for Customers; and
- protect Speedsurf's network and interconnected third-party networks.
Depending on the service and circumstances, these measures may include traffic management, rate limiting, prioritisation, filtering of malicious or abusive traffic, temporary restrictions or other reasonable network-management measures.
Speedsurf will manage its network reasonably and in good faith and will not regard ordinary high-volume Internet use, by itself, as abuse merely because a Customer uses an uncapped service extensively.
However, use deliberately or persistently conducted in a manner that materially degrades network performance for other Customers, circumvents reasonable network-management controls, or otherwise constitutes abuse may be investigated and managed in accordance with this AUP.
10. Residential Services, Business Use and Resale
Residential services are primarily intended for use by the Customer and members of the Customer's household at the premises where the service is installed.
Unless expressly permitted by Speedsurf, a Customer may not:
- resell the Internet service;
- operate as an Internet service provider using a Speedsurf residential connection;
- charge third parties for Internet access supplied through the service; or
- redistribute the service to other premises or unrelated third parties.
Normal use of a residential connection by household members, visitors and ordinary Internet-connected devices is permitted.
Business, hotspot, managed Wi-Fi, wholesale and other commercial services may permit broader use where specifically provided for in the applicable service agreement.
11. Servers and Internet-Connected Devices
Speedsurf does not prohibit ordinary Internet-connected devices, cloud services, gaming, CCTV systems, smart-home equipment, remote-access applications or similar legitimate applications merely because they maintain persistent Internet connections.
Customers may operate servers or remotely accessible systems where the applicable service permits this, provided that such systems:
- are operated lawfully;
- are reasonably secured;
- do not facilitate spam, malware or other abuse;
- do not materially interfere with the network; and
- comply with the Customer's applicable service agreement.
Speedsurf may restrict a server or device that creates a security risk, causes network abuse or violates this AUP.
12. Customer Responsibilities
The Customer is responsible for:
- reasonable security of its own computers, routers, Wi-Fi networks and connected devices;
- keeping passwords and authentication information secure;
- installing reasonable software and security updates;
- preventing unauthorised use of the service where reasonably possible; and
- taking reasonable corrective action when notified of abuse originating from the Customer's connection.
The Customer remains responsible for use of the service through the Customer's account or connection, subject to applicable law.
Where a Customer becomes aware that a device has been compromised, the Customer should take
reasonable steps to secure or disconnect that device.
13. Privacy and Monitoring
Speedsurf respects the privacy of its Customers and the confidentiality of their communications and personal information in accordance with applicable law and Speedsurf's Privacy Policy.
Speedsurf does not have a general obligation to monitor the content of Customers' Internet communications.
Speedsurf may, however, monitor network performance, traffic characteristics, security events and other technical information reasonably necessary to:
- operate and secure its network;
- investigate abuse;
- troubleshoot services;
- enforce this AUP;
- protect Customers and third parties; or
- comply with lawful regulatory, judicial or law-enforcement requirements.
Any processing of personal information will be undertaken in accordance with applicable law and Speedsurf's Privacy Policy.
14. Unlawful Content and Take-Down Requests
Speedsurf does not knowingly permit its services to be used to host unlawful content.
Where Speedsurf hosts or controls content and receives a valid take-down notice or is otherwise legally required to remove or restrict access to content, Speedsurf may remove or disable access to the affected content in accordance with applicable law.
Where appropriate, Speedsurf may cooperate with its designated industry representative body, lawenforcement agencies, courts or other competent authorities in dealing with unlawful content and activity.
Nothing in this AUP creates a general obligation on Speedsurf to monitor all Internet content accessed or transmitted by Customers.
15. Enforcement
A breach of this AUP may constitute a material breach of the Customer's agreement with Speedsurf.
Where reasonably appropriate, Speedsurf may notify the Customer of an alleged violation and provide the Customer with an opportunity to remedy it.
Depending on the seriousness, urgency and nature of the violation, Speedsurf may:
- issue a warning;
- request corrective action;
- block or filter abusive or malicious traffic;
- temporarily restrict or rate-limit the affected service;
- temporarily suspend the service;
- remove or disable access to unlawful hosted content where applicable; or
- terminate the service in accordance with the applicable agreement and law.
Speedsurf may take immediate action without prior notice where reasonably necessary to protect the network, Customers or third parties; mitigate an ongoing attack or security threat; comply with a lawful instruction; or address serious unlawful activity.
16. Costs Arising from Abuse
Where permitted by law and the applicable agreement, Speedsurf reserves the right to recover reasonable costs directly incurred as a result of a Customer's intentional or negligent violation of this AUP.
This may include reasonable technical, administrative, investigation or remediation costs.
17. Reporting Abuse
Suspected abuse of Speedsurf's network should be reported to:

Reports should contain sufficient information to allow Speedsurf to identify and investigate the alleged activity, including, where available, relevant IP addresses, dates, times, logs and other supporting information.
Speedsurf will investigate legitimate complaints and take appropriate action where required.
18. ISPA Code of Conduct
Where Speedsurf is a member of the Internet Service Providers' Association of South Africa ("ISPA"), Speedsurf upholds and abides by the ISPA Code of Conduct in respect of the services to which the Code applies.
The current ISPA Code of Conduct, complaints procedure and take-down procedure are available from ISPA's website.
19. Changes to this AUP
Speedsurf may amend this AUP from time to time to reflect changes in legislation, regulation, technology, network requirements or industry standards.
The current version will be published on Speedsurf's website.
Where required by law or the Customer's agreement, material changes will be communicated to Customers.
Continued use of the service following the effective date of an amendment will be subject to the updated AUP, to the extent permitted by law.
